Sierra Club, Inc. v. Sandy Creek Energy Assoc., L.P. (Revised) (5th Circuit)
Fifth Circuit holds that the ongoing construction of a coal-fired power plant without a final Maximum Available Control Technology permit violates the Clean Air Act. Although appellant commenced construction during the period in which a MACT determination was not required, the Act requires a permit for ongoing construction, not just the commencement of construction. |

Transmission Agency of Northern California v. FERC (D.C. Circuit)
Municipalities seek review of FERC's orders approving the ISO's plan to combine two municipal utilities districts for the purpose of pricing transactions. After finding that FERC had jurisdiction over the issue, despite the fact that a non-jurisdictional entity was involved, the D.C. Circuit denies the petitions. The record supports FERC's finding that the highly integrated nature of the two districts present unique characteristics justifying consolidation. |

Transwestern Pipeline Co. v. Agua Fria Investments, LLC (9th Circuit)
The Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 allows landowners to seek reimbursement for certain costs and fees for a condemnation proceeding instituted by a federal agency. Ninth Circuit holds that the Act does not apply to a condemnation proceeding prosecuted by a natural gas pipeline operator granted authority by FERC. Plaintiff is not entitled to be reimbursed for the attorney fees and costs it incurred in opposing the pipeline's condemnation action. | |
